1. Purpose

It is specified that the present conditions govern exclusively the sales of Arghenoia products through its website www.arghenoia-shop.com (the Site). The designer of the brand Arghenoia is the official publisher of the site (the Publisher). By placing an order and making a purchase through the site, the customer accepts these terms and conditions. The publisher of the site reserves the right to modify at any time these terms and conditions, as long as the modifications appear on the site. The customer can consult freely and at any time these terms and conditions by clicking on the link ’’ Terms of Use’. Thus, any product order placed on the site by the customer involves his or her definitive and irrevocable agreement to all the terms and conditions set out below.

2. Products

Each product is handmade, and therefore unique in its nature. Consequently, products can present slight differences in manufacture. The products sold on the site are those that are listed on the site within their stock availability. The customer is informed of the unavailability of a product by a message « sold out ». For each product listed on the site the customer will find its full characteristics, thus having the opportunity to take knowledge of the essential characteristics and features of a product before the final confirmation of his or her order. The characteristics of the products shown may be subject to change, and no changes can give rise to a claim of any nature whatsoever. The photographic visualization of products on the site does not always allow an exact display their actual colors and / or materials. In addition, the configurations of workstations and monitors can show the buyer a few variations compared to reality. Consequently, the responsibility of the publisher of the site can not be held due to a slight difference between colors and / or material displayed and colors and / or material of the delivered product.

3. The Prices

Product prices on the site are in euros, excluding the shipping costs. VAT is not applicable, according to Art. 293 B of the local CGI law. 4. Order

If the customer wishes to order, he or she will fill out a form, following the provided indications, where he or she will include the information necessary for identification. This information includes his or her name, postal address, telephone number and email. The customer will be presented with a full summary of the chosen products, and will definitively confirm his or her order based on the summary that appears on the screen. By “clicking” the check box, the customer demonstrates his or her commitment and acceptance of general conditions of sale. Any order gives proof of acceptance of the prices of the products, product descriptions and terms and conditions of use. The order placed on the site will be confirmed to the client as soon as possible with an order confirmation via email. Before the payment of the order is placed, it can be canceled at any time, either by establishing a new order or by the non-payment of the amount of the order. Unless proven otherwise, the data recorded by the site constitutes proof of all transactions made on the site.

5. Payment Method

All purchases made on the site are solely payable with an established order. No product can be shipped to a customer if he has not paid in advance 100% of the product price and any related delivery charges. To insure that no dispute concerning the amounts paid by the customer occurs, the site always automatically addresses the customer a confirmation e-mail with the registered order number. The settlement of purchases is made by using credit cards: Visa, MasterCard, American Express, other credit cards through the PayPal secured platform, or by the credit card directly linked to the customer’s PayPal account. The publisher of the site reserves the right to suspend any order and any delivery in case of a refusal to authorize payment by the credit card, or in case of non-payment and / or fraud, and to prosecute the perpetrator or perpetrators of the latter. The publisher of the site specifically reserves the right to refuse delivery or to deliver an order to a customer who has not fully paid a previous order, or with whom has a current payment dispute.

6. Terms of Delivery

Products purchased on the site can be delivered within France and abroad. Shipping is made to the address specified by the customer when ordering. The shipment can only be made once the order is validated by the customer and payment made in full. The payment platforms concerned have therefore given their prior agreement to pay. In case of refusal, the order will be canceled. Shippment will be made by Colissimo. The customer will receive an email giving him the package tracking number to access package tracking information on Colissimo website, allowing him to know when to expect the delivery. The customer is obliged to check the conformity of the goods delivered at the time of delivery. In case of an anomaly concerning the delivery (damage, missing product compared to the delivery order, damaged package, broken product …). The customer will need to send an email to the following address: contact@arghenoia-jewelry.fr (or arghenoia@gmail.com) stating the anomaly, not later than the first business day after the delivery . Any claim made beyond the three days following the delivery will not be accepted. Upon absence of complaints and reservations on the part of the customer the item delivered is deemed satisfactory, and will not be subject to any subsequent dispute.

7. Delivery Time

For any item available in stock, the delivery time is 3 to 5 business days for the Metropolitan France. Note that during the month of August and between December 24th & January 1st the delivery time is longer: 6-8 business days for France. The delivery time starts from the moment the order has been processed. The order processing time for shipping is 24 to 48 hours. The delivery time for other destinations will vary depending on the destination. In case of force majeure or exceptional events (natural disaster, epidemic, strike, lockout, etc.) delaying or preventing the delivery of goods, the publisher of the site is relieved of all responsibility. Delays in delivery can not give rise to any penalty or compensation or justify the order cancellation.

8. Claims

The customer should contact the site publisher via email contact@arghenoia-jewelry.fr (or arghenoia@gmail.com), or use the contact form on the website the day of the delivery or no later than the first business day after the delivery to make any claims on the error of delivery and / or non-conformity of goods in type or in quality compared to entries on the order confirmation. Any claim made after this time will be rejected. Any claim not made in the rules defined above, and not on time will not be taken into account and releases the site publisher from any responsibility towards the client.

9. Returns and Refunds

From the date of delivery of the order, the customer has a period of 7 days to assert his right to withdrawal. This right is applicable on agreement of both parties, and this in accordance with Article L.121-20-2 of the local Consumer Law. However, only products returned in perfect condition and in their original packaging and with written agreement from the publisher of the site may be returned for a refund. The costs of shipping and returns are at the customer’s expense. The customer is solely responsible for the package and its contents during the return of the goods, and will take all necessary steps to ensure the risk of loss, theft or damage of the package. In the case of a shipment without insurance the publisher of the site can not be held responsible for loss or theft during transit. Refunds and returns do not apply to products that were purchased with a “promotional code” and custom orders or personalized size products (rings, chains, bracelets, necklaces …), including one or more customizations of the product for the client.

10. Terms of Warranty

All jewelry sold on the site of the brand Arghenoia have a 1 year warranty against any hidden defects. Broken items, as well as damages caused by inappropriate and / or damaging use of the product, and the product’s lost parts are not guaranteed.

11. Ownership

The site’s publisher retains the ownership of the goods until full payment is made by the customer. The transfer of ownership of products to the customer occurs at the time of full payment. However, during the period between delivery and transfer of the ownership, the risk of loss, theft or destruction shall be borne by the customer. In the case of failure of payment by the customer, whatever the cause, the publisher of the site gives the right to demand the immediate return of goods delivered at the expense, risk and peril of the customer.

12. Intellectual Property

Arghenoia is a registered trademark with the INPI (National No: 14 4077088). Jewelry accessories, pictures, objects, images and texts proposed on the site are protected by the law of intellectual property. The buyer acknowledges that the use of the ordered products is limited to the use and purpose intended by the product. Any other use of the models, logos, photos, objects and images, such as reproduction, marketing, distribution and publishing by any person is prohibited.

13. Protection of personal data

The information collected for purposes of distance selling is required. This information is essential for processing and delivery of the orders, preparing invoices and warranty contracts. The lack of information will result in the cancellation of the Order. According to the law, the customer has the right (Article 34 of the Act of 6 January 1978) to access, modify, rectify and delete any data concerning him or her. The customer can address and email regarding the demand demand of such kind to contact@arghenoia-jewelry.fr (or arghenoia@gmail.com). Moreover, the site publisher assures and takes responsibility not to communicate any information concerning the customer to any third party.
